This User Agreement describes the terms and conditions which you accept by using our website, Mobile Application, or Services. We have incorporated by reference some linked information.Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Website, which means the Websites/Mobile Apps operated by Shawir and available at: shawir.com and any of its regional or other domains or properties, and any related Shawir service, tool, or application, specifically including mobile web, any iOS App, any Android App, and any other Mobile App or Web App (“the Website” or “the Platform”).The Platform links Users (“you”, “your”) to selected Experts to provide billable consultations (the “Service”) through Shawir (“Company”, “us”, “we”, or “our”).The present agreement sets out the terms and conditions for all users of the Website and Shawir platform. By accessing the Website and/or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Acceptance of the Terms / Terms of Use
- When you visit the Website or send us emails, you are communicating with us electronically.
- You consent to receive electronic communications from Shawir.
- All agreements, notices, and other disclosures communicated electronically satisfy any legal requirement that communication be in writing.
- Shawir reserves the right to amend these Terms at its sole discretion by posting updates on the Website. Changes become effective upon posting.
- If you disagree with any changes, your sole remedy is to cease using the Website.
- Communication of updates occurs whenever Terms are modified, and users must accept the changes.
- You must be at least 18 years of age to use the Website.
2. Website & Platform
- Shawir is a platform that enables access to a website for registration and informational purposes.
- Shawir acts as an intermediary between Users and Experts; it is not a contracting party and cannot be held liable for wrongful acts of Experts or Users.
- Experts are independent service providers and not employees of Shawir.
- Shawir does not endorse or recommend any particular Expert.
- The Website includes all Shawir content such as text, software, music, images, videos, guides, educational materials, and more (“Content”).
3. User Accounts
- When registering, Users create an account using a mobile number, personal information, username, and password.
- You are responsible for maintaining account security and preventing unauthorized access.
- Information collected includes name, mobile number, email, birth date, gender, browser logs, IP address, cookies, and requested pages.
- Controlling dissemination of passwords.
- Monitoring access to your Shawir account.
- Promptly notifying Shawir if your account is compromised.
- Lost passwords or stolen devices: Shawir may block or transfer accounts upon verification.
- Must not be fraudulent, misleading, illegal, competitive with Shawir, defamatory, obscene, or contain harmful code.
- You can edit account information anytime.
- To deactivate your account, contact [email protected].
4. Experts
- Experts must register and provide official documents (ID/Passport, syndicate card, certificates).
- Expert information is reviewed before posting publicly. Shawir may remove irrelevant content.
- Positive approval allows Experts to start receiving billed consultations.
- Experts must answer questions related to their field and report spam, harmful, or illegal content.
- Consultations must follow local laws; Shawir is not liable for illegal consultations.
- Experts cannot share Users’ personal information unless required for consultation with colleagues or by law.
5. Billing, Reserve & Refund
- Shawir does not store credit card information; Users are redirected to payment gateways.
- Billing is determined by Experts and limited by maximum charges per consultation.
- Users can cancel unanswered questions after 1 hour for a full refund.
- Shawir charges a commission for handling connection and payments.
- Experts can request withdrawals once their wallet reaches $100.
- Issued at Shawir’s discretion after investigation.
- Credits refunded in-app; money refunds to original payment method.
6. Data Protection
- Users’ privacy and safety are a priority; personal and consultation data are not disclosed to third parties.
- Experts and Users may save conversations on their devices; they must ensure device security.
- Shawir uses secure, encrypted networks and encrypts account passwords and critical information.
- Consultations’ data (date, Expert, duration, text, billing) may be analyzed to improve services.
7. Communication Between Experts & Users – Responsibility and Liability
- Liability for consultations is restricted between Users and Experts.
- Shawir only connects Users to Experts; selection is Users’ responsibility.
- Experts should avoid emergency or high-risk consultations.
8. Consultation Experience
- Experts set availability and typical response times (2–48 hours).
- Users can cancel consultations if Experts do not respond within 1 hour for a full refund.
- Platform supports text, voice, and video consultations.
- Billing is independent of outside actions.
9. Report & Rate the Experience
- Users and Experts can report abuse or dissatisfaction.
- Shawir may investigate and take action including freezing or deactivating accounts.
- Post-service, Users can rate Experts via Shawir’s rating system.
10. Exclusion of Warranties
- This Agreement supersedes any prior agreements or representations.
11. Limitation of Liability
Shawir is not liable for:- Punitive or exemplary damages.
- Special, consequential, incidental, or indirect damages, including lost profits or data.
12. Indemnification
- Users and Experts agree to indemnify Shawir and its affiliates against any claims, damages, or expenses arising from this Agreement.
- Experts are responsible for defending Shawir if prosecuted due to their actions or omissions.
13. Applicable Law & Dispute Resolution
- Governed by UAE-Abu Dhabi laws.
- Disputes are first resolved via arbitration, then may be referred to UAE-Abu Dhabi courts.
14. Force Majeure
- Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., power outages, war, natural disasters, network interruptions).
15. Copyright
- Shawir owns all rights, titles, and interests in the Copyrights.
- Copyrights are registered or in process and are valid and enforceable.
